Statutory & Regulatory

Statutory & Regulatory requirements in universities are of paramount importance, as they have the potential to heavily influence and even dictate the day-to-day operations of the institution. In India, there are both national as well as state-level statutes and regulations which govern the functioning of universities and their constituent departments. These laws and regulations are formulated and implemented by the UGC. The university management must ensure that it complies with all the applicable statutory and regulatory provisions. We at Profmax help our clients by assisting in statutory compliance across various Indian states /UTs through a single window.

Trust/ Society Formation

In the current scenario, when there is an increasing trend towards private higher education in India, it becomes essential to have a group of trustees who are representative of the stakeholders in a university. These trustee groups should operate as the apex body of the university’s governing council and act as a link between the government and the academics. In addition, it should ensure that the university is governed in accordance with the rules and regulations laid down by the government.
We at Profmax help universities to set up such a group and manage the overall functioning of the university. From legal and regulatory perspectives, the setting up of a trust is governed by the provisions of the Indian Trusts Act, of 1882, The Societies Registration Act, of 1860, and the Charitable Endowments and Funds Act, of 1890. In addition to these provisions, a number of additional regulatory requirements must be adhered to when setting up a trust for a university.
We at Profmax take care of all the aspects of the formation of the group of trustees by managing the process in a professional manner keeping in mind the law and other regulatory requirements.

Legal Structuring

India is home to a burgeoning number of universities, which has created an increasing need for legal structuring and management of these institutions. The legal framework governing universities in India is complex and layered, with various statutes and regulations governing a wide range of issues.
We at Profmax have been helping a number of universities and institutes set up their operational structures in accordance with the requirements of the relevant laws. From getting required documents to granting academic recognition to the institution, we can help with all aspects of university setup and management.

Govt. Approvals - NOC

Earlier this year, the Government of India approved a new regulatory framework for universities called “The NOC Framework”. This framework will allow universities to obtain a “No Objection Certificate” (NOC) from the government in order to raise funds for investments in their campuses. The goal of this new regulatory system is to make it easier for private capital to invest in Indian higher education facilities. Before this new system was adopted, university administrators were required to seek approval from multiple ministries in order to acquire funding for new infrastructure or technology projects. This system created significant delays and made the process of acquiring funding much more difficult and cumbersome. Under the new system, university administrators can obtain a NOC from the central government after applying to one ministry and receiving approval from that ministry.
Through the new process, Profmax assists universities across the country in obtaining NOCs for infrastructure projects. We have successfully assisted several universities in acquiring NOCs for their infrastructure needs.

Board Affiliations

School board affiliations are an important part of the governance structure of schools. They can provide schools with important resources, such as expertise in curriculum and instruction, financial support, and networking opportunities. They also provide an opportunity for schools to demonstrate their compliance with regulations and compliance frameworks. But getting Board affiliation is not as easy as it seems. Schools need to follow certain protocols and demonstrate adherence to laws and regulations before they can get Board affiliation.

Therefore we at Profmax help schools get board affiliation hassle-free as we understand the process involved and can help with everything that needs to be done. From government approvals to required documents to insurance and much more we can help you in every step of the way and get the required approvals in no time so that you don’t have to spend hours trying to sort things out.

Regulatory Compliances

As a consultancy company, we are often asked about regulatory compliance for universities. Here, we would like to give you a quick overview of the different compliance requirements for universities in India.
The Academic Performance Index was introduced by the Ministry of Human Resource Development in 2015 and it has become an important ranking system to evaluate the quality of higher education in the country. It is also part of the government’s efforts to promote academic excellence among institutions of higher learning. The ASPIRE framework provides direction on how the National Institutional Ranking Framework (NIRF) parameters can be used to measure institutional performance and quality. This framework covers five broad areas—Teaching-learning environment, Research and Professional practices, Graduation outcomes, Outreach and Inclusivity, and Perceptions. The UGC conducts an annual ranking of higher education institutions based on the National Institutional Ranking Framework (NIRF) scores.

We at Profmax help universities to strategize and make plans to gain top ranking in the NIRF.

Mock Inspection

There is a growing trend in the consulting industry for mock inspections of universities. It helps Universities to Identify problems early and fix them before they become critical. It also encourages the faculty and the administrative staff to be proactive and work together to improve overall efficiency in the university. A mock inspection is carried out by two senior consultants from our company. The consultants spend a day or two at the premises of the university and analyze the existing systems and processes, identify gaps and make recommendations for improvement.
The recommendations are then discussed with the management at the university and an action plan is developed based on the feedback from the senior management.
